Medical devices liability update

The recent Poly Implant Prothèse (PIP) scandal in Germany and France has renewed the spotlight on medical devices liability of Notified Bodies under the Medical Device Directive.  A higher court in France ruled that notified bodies are not under an obligation to carry out onsite inspection unannounced. It modified the wrongdoing charges from PIP on technical grounds.
